Warren and Sanders lead inquiry into whether Sacks exceeded his government employee status
Congressional Democrats are raising concerns over the role of David Sacks, President Donald Trump’s top adviser on crypto and artificial intelligence, questioning whether he has surpassed the legal limits of his temporary federal employment.
The 130-Day Rule Under Scrutiny
Sacks has been serving as a “special government employee” (SGE) — a designation meant for temporary appointments that cannot exceed 130 working days per year. In a letter issued Wednesday, Senator Elizabeth Warren, joined by Senator Bernie Sanders and other lawmakers, pressed Sacks to disclose the exact number of days he has worked since the administration began in January.
“If you have worked every business day, your 130th day was July 25, 2025,” the letter states, warning that any overstay could undermine congressional intent behind the SGE designation.
The lawmakers argue that Sacks’ dual role — advising the White House while maintaining ties to his venture firm Craft Ventures — raises potential conflicts of interest.
Part of Trump’s Broader Use of SGEs
President Trump has relied heavily on SGEs to bring high-profile figures into government without lengthy hiring processes. Earlier this year, Elon Musk also briefly served under this designation. While the role is designed to inject expertise into federal policymaking, critics say it allows influential figures to bypass transparency requirements.
Democrats have introduced bills aimed at limiting financial gain for SGEs and tightening restrictions on how long they can serve. Warren has been particularly vocal about curbing what she describes as “loopholes that invite abuse.”
Sacks’ Role in Crypto Policy
Since Trump took office, Sacks has led the administration’s digital asset strategy, overseeing the rollout of a landmark law regulating U.S. stablecoin issuers. He has also acted as a central figure within the President’s Council of Advisers on Digital Assets, where he works closely with executive director Patrick Witt.
With more than 170 business days now elapsed in Trump’s presidency, Democrats are pressing for accountability. Whether Sacks’ continued service violates his SGE designation could influence not only his position but also the future use of temporary federal appointments in shaping crypto policy.
