Senior leaders at the U.S. Securities and Exchange Commission said they are working to clarify how tokenized securities fit within current federal securities laws, offering fresh signals on the agency’s approach to digital asset oversight.

Speaking at ETHDenver in Colorado, SEC Chair Paul Atkins and Commissioner Hester Peirce addressed industry concerns about regulatory uncertainty and recent cryptocurrency market volatility.

Their remarks followed a sharp pullback in digital asset prices, with Bitcoin and Ether declining significantly over the past month. Atkins emphasized that regulators should focus on ensuring that market participants have access to clear, consistent information so they can make informed decisions to buy, sell, or hold assets.

Market Structure Debate and SEC–CFTC Jurisdiction

Although neither official detailed legislative strategy, Peirce confirmed the SEC has provided technical assistance on pending market structure proposals in Congress. One proposal, known as the CLARITY Act, could shift substantial oversight authority for digital assets from the SEC to the Commodity Futures Trading Commission.

The regulatory debate comes as the CFTC operates with limited leadership, following the confirmation of a single commissioner to serve as chair. Lawmakers have proposed requiring a broader slate of commissioners before major structural reforms take effect.
