Celsius Founder Mashinsky Permanently Banned in New York Fraud Settlement
Former Celsius CEO Alex Mashinsky has been permanently barred from the cryptocurrency, securities and commodities industries under a deal with New York Attorney General Letitia James. The agreement, announced Friday, closes a civil lawsuit filed in 2023 that accused him of misleading hundreds of thousands of investors about how safe Celsius really was before it failed in 2022. James said Mashinsky told New Yorkers their savings were secure, then left them with nothing after his risky bets collapsed.

Conditional Payments of Up to $35 Million
The settlement carries up to $35 million in conditional payments. Mashinsky owes New York $25 million if he does not forfeit another $10 million in illegal gains to the federal government, on top of assets already surrendered. A further $10 million is due if he fails to serve his full prison term. He is currently serving 12 years in federal prison after pleading guilty in December 2024 to securities and commodities fraud, and was ordered to forfeit more than $48 million.
How the Celsius Collapse Unfolded
The 2023 lawsuit said Mashinsky sold Celsius as a safer option than banks, advertising yields of up to 17% while hiding risky investments and growing losses. By early 2022 the platform held about $20 billion in digital assets but could not earn enough to cover its promised returns, according to the CFTC. Withdrawals were frozen in June 2022, and bankruptcy followed a month later with a shortfall above $1 billion.

Earlier Federal Settlements and Appeal Efforts
This deal follows other penalties this year. The CFTC permanently banned him from trading and registration in June. In April, the FTC barred him from crypto and finance work, requiring a $10 million payment and a largely suspended $4.72 billion judgment. The SEC reached an agreement in principle in September, and a federal judge dismissed its case without prejudice on Sept. 29 while the settlement is finalized.
