New SEC and CFTC Initiatives Explained

The SEC’s five year Innovation Exemption, introduced September 17, lets qualifying venues trade tokenized US stocks through blockchain liquidity pools. On October 5, the CFTC began seeking feedback on leveraged retail crypto trading and a new registration category. An SEC custody proposal from October 1 would also let state trust companies safeguard client crypto.

Executives See M&A and Tokenization Opportunities

Paul McCaffery of KBW said agency action is unlocking M&A across digital assets and fintech. Bitwise CIO Matt Hougan said the agency path is more favorable short term than slow legislation, and expects more token buyback models.

Legal Experts Warn of Lasting Gaps

Lev Breydo of William & Mary Law School said the coalition that looked unified against Gensler found that definitions create winners and losers. Derek Lowrey of Newton Labs called implementation the biggest gap, while Kevin Kreuser of D3 said agency action lacks the durability of law.

Hougan argued the delay protects incumbents like Coinbase and Kraken, preserving a regulatory moat. Breydo said only Congress can deliver a comprehensive framework.
