Bill Faces Democratic Resistance Over Ethics Provisions
The CLARITY Act has already advanced through the Senate banking and agriculture committees, but needs 60 votes to pass in a chamber where Republicans hold a narrow 52-47 majority. Democrats have raised concerns that ethics provisions barring public officials from issuing cryptocurrencies do not go far enough to prevent corruption, with Senator Ruben Gallego calling the Republican counterproposal an inadequate effort despite months of bipartisan negotiation.

Industry Leaders Back The Legislation
Coinbase CEO Brian Armstrong argued the current lack of a federal framework has allowed bad actors to harm customers while pushing much of the industry offshore, saying the bill would introduce stronger consumer protections. Legal experts have also said the bill would help create clearer rules for non-custodial crypto platforms.

Delay Could Push Vote Closer To Midterms
If the Senate fails to vote before August recess, consideration could slide closer to the 2026 midterm elections, complicating the bill’s path forward. Prediction market platform Kalshi currently shows roughly a 40% chance of passage before the break.
