EU Regulator Probes Whether Tokenized Collateral Can Be Turned Into Cash During a Market Crisis

The European Securities and Markets Authority opened a call for evidence on Friday to learn whether clearinghouses can reach tokenized collateral and sell it quickly if markets come under stress. The industry feedback will help decide whether extra EU measures are needed. ESMA Chair Verena Ross said tokenized markets must be able to work safely and at scale across borders, backed by legal certainty, interoperable infrastructure and proper supervision. Tokenized collateral is already appearing in live European clearing, as banks and investors look for faster ways to source securities for margin calls. The review will test whether current rules let a clearinghouse access and liquidate such assets when a member defaults.

Liquidity and Ownership Risks of Tokenized Assets

The consultation looks at tokenized versions of assets held in traditional systems as well as assets issued natively on distributed ledgers, and how both interact with stablecoins, central bank money and tokenized deposits. The regulator noted that even assets that are liquid in their usual form can carry new risks once tokenized, such as redemption delays or transfer limits. It also asks whether moving a token actually gives the holder ownership or enforceable rights over the underlying asset.

Eurex Clearing, Pontes and the Road to Tokenized Clearing

Eurex Clearing launched a collateral service built on distributed ledger technology in July 2025, and JPMorgan carried out the first live transaction for Dutch pension investor PGGM. The call follows the Eurosystem’s September launch of Pontes, which lets financial institutions settle tokenized asset deals in central bank money. ESMA said Pontes could support tokenized collateral by linking blockchain-based systems with existing settlement infrastructure.
