What The Bill Would Change

The House Ways and Means Committee’s 114-page proposal, called the Digital Asset Tax Certainty Act, covers de minimis transactions, gain and loss accounting, transfers, wash sale rules, mining, staking and broker requirements. A key provision would eliminate taxes on small transaction fees under $10, though people with more than 5,000 transfers in the prior year would not qualify.

The change addresses a long standing industry complaint that even small crypto purchases, like buying coffee, currently trigger reportable capital gains or losses. The bill also includes rules for tokenized assets and clarifies how ownership is treated when digital assets change hands, while directing the Treasury Department and IRS to issue further guidance.

Limited Time Before Year’s End

The measure builds on earlier crypto tax proposals from lawmakers over the past year. Wednesday’s markup could mark the first real legislative movement on crypto taxes, though passage this year is unlikely since the House is set to break until after the November election. Any progress now could carry into the next Congress in 2027. Separately, the House may also take up the Senate’s broader crypto market structure bill later this fall, assuming it clears the Senate, where a procedural vote requiring 60 votes is scheduled for Tuesday amid ongoing Democratic concerns over ethics provisions.
