Michigan Escalates Legal Fight Against Kalshi as Supreme Court Battle Approaches

Michigan’s Attorney General announced that a state court has approved a preliminary injunction blocking Kalshi from offering event contracts to residents, following months of legal disputes over whether the platform’s sports related products amount to unregulated sports betting. Under the order, the company could face fines of up to $500,000 per day for violations. State officials say the ruling further protects residents from what they describe as unlicensed gambling activity disguised as investment products.

Conflict Between State and Federal Authorities

The injunction follows an earlier temporary restraining order issued in June, which prompted federal regulators to instruct Kalshi to continue operating despite the state’s directive, placing the company in a difficult legal position between conflicting state and federal requirements. Kalshi has maintained that it disagrees with Michigan’s ruling and intends to challenge it in court, while continuing to comply with current restrictions.

Case Could Reach the Supreme Court

On the same day as Michigan’s ruling, New Jersey officials filed a petition asking the US Supreme Court to weigh in on the broader legal question of whether federal or state authorities have jurisdiction over prediction markets.

Legal experts suggest the Supreme Court may eventually take up the issue, either through this case or others working through the courts, given the growing number of similar lawsuits nationwide. Some lawmakers have also proposed federal legislation that would restrict certain event contracts resembling sports betting, potentially resolving the dispute through Congress instead of the courts.
