xAI Sues Minnesota Over New Law Targeting AI ‘Nudification’ Technology

Elon Musk’s AI company xAI has filed a lawsuit challenging Minnesota’s first-in-the-nation law banning “nudification” technology, setting up a legal test over how far states can go in regulating artificial intelligence tools.

Lawsuit Targets Law’s Scope, Not Its Intent

Filed just days before the law takes effect, xAI’s lawsuit argues the company does not oppose banning non-consensual AI-generated nude images of real people. However, it claims Minnesota’s law extends far beyond that goal, potentially covering constitutionally protected content and imposing penalties of $500,000 per violation. The company also argues the law lacks protection for companies making good-faith efforts to prevent misuse, and that its definition of intimate body parts is overly broad.

State Officials Defend the Law

Minnesota’s attorney general said he had not yet reviewed the lawsuit but firmly defended the law’s purpose, describing AI-generated nude images created without consent as deeply harmful to victims emotionally, personally and professionally. He emphasized that protecting people from this type of exploitation should not be a contentious policy debate.

Part of a Broader Legal Landscape

This case adds to a growing patchwork of state and federal efforts addressing AI-generated explicit content, including a federal law requiring platforms to implement content removal processes. Other states, including Texas, have taken different approaches by holding platform owners liable when they fail to act on known violations.

Company Points to Existing Safeguards

xAI said its terms of service prohibit using its Grok AI tool for illegal or abusive activities, including non-consensual sexual image alteration, and that it enforces these rules through account suspensions and reporting mechanisms. The company previously implemented additional safeguards earlier this year following global criticism over sexualized AI-generated content involving real people.
