Senators voted 49 in favor and 50 against advancing the Digital Asset Market Clarity Act on September 15, significantly lowering the odds of the bill passing before the current congressional session ends. While some industry advocates haven’t ruled out another vote during a lame-duck session, crypto-aligned political action committees appear ready to act regardless.

Fairshake Targets Ohio Senate Race

Fairshake, a PAC backed by Coinbase and Ripple Labs, plans to spend $30 million opposing Sherrod Brown in Ohio’s Senate race. Brown previously chaired the Senate Banking Committee and has historically supported policies critical of the crypto industry. A law firm partner noted that the CLARITY vote gave the industry clarity on which lawmakers are reliable long-term allies, making it harder for those who voted against the bill to secure industry financial support going forward.

Industry Groups Warn Of Political Consequences

Stand With Crypto, an advocacy initiative, cautioned that lawmakers who blocked the bill’s advancement could face consequences at the ballot box, saying the vote made clear which officials support the industry. As of this week, several major crypto PACs, including Fairshake and affiliated groups, had not yet disclosed new post vote spending to federal election regulators, though past election cycles suggest large-scale spending could follow.
