According to the bank’s analysis, prediction markets now imply just a 37% chance the legislation passes before year-end, following the Senate’s decision to prioritize other bills ahead of its summer recess. Negotiations remain stalled over several unresolved issues, including ethics provisions, enforcement standards, decentralized finance rules, stablecoin yield restrictions and anti-money laundering requirements.

Delay Risks Losing Ground to Traditional Finance

JPMorgan analysts warned that prolonged delays could allow traditional financial infrastructure to absorb the growth of tokenization and blockchain-based applications, rather than that value accruing to public crypto networks. The bill is widely viewed as essential for the next stage of institutional crypto adoption, since clearer rules dividing oversight between the SEC and CFTC could give banks, brokers and asset managers greater confidence to build products and infrastructure around digital assets.

Some Institutional Momentum Already Building

Despite regulatory uncertainty, JPMorgan pointed to early signs of institutional engagement, including a major investment tied to Crypto.com and regulatory approval of the first U.S.-regulated perpetual crypto futures contracts. Still, the bank cautioned that certain provisions in the current bill draft could actually discourage institutional participation by allowing some tokenized securities and derivatives to trade outside formal SEC or CFTC oversight, with lighter compliance requirements than traditional financial firms face. Other analysts have similarly noted the legislation still faces meaningful hurdles despite clearing an earlier Senate committee vote.
