The official notice was released Wednesday night, with the new tariff set to take effect July 22. The measure carves out several major exceptions, including oil and gas, beef, coffee, and oranges. The exemption list itself runs nearly 100 pages, covering products where tariffs could risk causing broader economic disruption due to domestic supply shortages.

Legal Basis and Political Backdrop

The tariff follows a Section 301 investigation under the Trade Act of 1974. US Trade Representative Jamieson Greer cited a range of concerns with Brazil, including digital trade practices and limited market access for American businesses. Secretary of State Marco Rubio added that Brazil has not negotiated with the US in good faith, arguing that Brazilian President Luiz Inácio Lula da Silva has prioritized personal pride over reaching an agreement.

Lula responded by calling the tariffs a troubling development, pointing out that the US actually runs a trade surplus with Brazil. He described the move as connected to what he called a broader plan involving the Bolsonaro family, referencing former president Jair Bolsonaro, a Trump ally who was convicted of planning a coup after losing reelection.

A Bigger Global Tariff Push Underway

This Brazil-specific action is just one piece of a much larger tariff strategy. A separate Section 301 investigation, which advanced to public comment stage on June 2, focuses on countries accused of failing to address goods produced through forced labor. That investigation is expected to result in a 10% tariff on the European Union and 14 other nations, including Canada, while roughly 45 additional countries, including China, could face a 12.5% rate. The European Union has already called the move unjustified.

More Tariffs Could Follow

Additional Section 301 investigations remain ongoing, including ones focused on excess industrial capacity affecting several major trading partners, as well as a separate inquiry involving Vietnam.

Background on the Tariff Strategy

This week’s rollout represents the implementation phase of a long planned effort to permanently replace the 2025 tariffs that the US Supreme Court struck down back in February. That ruling led to billions of dollars in refunds, including nearly $50 billion paid out to businesses in June alone.

The administration also recently chose not to renew the United States Mexico Canada Agreement, triggering a mandatory annual review process. A temporary 10% global tariff, implemented under Section 122 of the Trade Act in February, is expected to expire this summer, meaning the new permanent measures may not significantly shift overall tariff rates from where they already stand.
